FilipinoContractors.com and FilipinoContractors.ph are services and platforms provided by DarinPhillips.com. They are wholly owned and operated by DarinPhillips.com. As such, the Terms of Service here are the same as those for the parent company, DarinPhillips.com.

These sites and platforms were created exclusively for hiring managers/companies from the United States of America and contractors from the Philippines. These sites and platforms were created to facilitate a better experience for both hiring managers/companies and independent contractors. Users from other countries are in violation of our Terms of Service and should immediately stop using FilipinoContractors.com and FilipinoContractors.ph.

FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com are not employment agencies or any other type of agent for the site users. We do not have authority to act on behalf of any Hiring Manager or Company or Independent Contractor. Nothing on these sites or in this Terms of Service should be construed as creating an agency relationship.

FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com may remove any content, disable any account, and/or restrict access to these sites for any reason and without notice. We reserve this right to protect our users and our interests. Users agree that FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com may make such discretionary decisions and actions without liability, refunds, or other recourse.

Hiring Managers and/or Companies

1. FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com are compensated by Hiring Managers and/or Companies for the posting of jobs or requests. These posts are provided by third parties over whom FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com has no control. If a post or request violates our Terms of Service, FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com will remove it as soon as possible after we are notified. We do not actively review every post or message.
2. Users may exaggerate - or blatantly lie about - knowledge, skills, experience, aptitude, work style, employment history or pay, etc. Once selected, Independent Contractors may also lie about availability (e.g. family emergencies), request advance payment (e.g. computer broke), or make other false or misleading claims or statements. You know and understand this and will not hold FilipinoContractors.com, FilipinoContractors.ph, and/or DarinPhillips.com responsible or liable for false or misleading statements made by any user(s). Nor will you hold FilipinoContractors.com, FilipinoContractors.ph, and/or DarinPhillips.com for decisions or actions you take as a result of lies told by any User.
3. The Hiring Manager and/or Company is responsible and liable for compliance with all applicable laws and regulations in their location. Independent Contractors are responsible for and liable for compliance with all applicable laws and regulations in their location. FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com are not liable for legal, regulatory, ethical, or other violations by the Hiring Manager and/or Company and the Independent Contractor.
4. FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com does not confirm or validate the accuracy or completeness of any posts on our site - including those in the blogs. If any information is reported to us as inaccurate or incomplete, we will review and act on those posts as soon as possible.
5. FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com does not control the selection process by Hiring Managers and/or Companies. You acknowledge and understand that the process that you impose upon Independent Contractors are outside of our control and that you are completely liable for any legal violations or other transgressions in the materials and/or steps taken to source, attract, and select a contractor. These may include US and/or Philippine laws and regulations.
6. FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com do not guarantee that any user will be qualified for any role or proposal posted on our platform. You agree that you are personally responsible for determining which independent contractor is ready and able to do the work that you are hiring for. You also agree that Independent Contractors may directly contact you based on the information that you provide on FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com. There are no guarantees that you will find a match.
7. If you publish a position or information on FilipinoContractors.com, FilipinoContractors.ph, and/or DarinPhillips.com, you understand that other users can search the site and find your post(s). If another user or software grabs content from our site and publishes it somewhere else, FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com will not be responsible or liable for what those persons or companies do with that information. There are bad actors in the world and you acknowledge that FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com cannot be held responsible or liable for those third parties.
8. All payments are handled directly by PayPal - outside of our sites or control. Thus, FilipinoContractors.com, FilipinoContractors.ph, and/or DarinPhillips.com are not responsible or liable for hacking of your payment information or PayPal account. We do not collect or store any user payment information. Our fees are listed in US Dollars. You are responsible for reporting all payments to the appropriate authorities.
9. At any time, Users may edit or remove their post(s) from FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com.
10. At any time, FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com may remove user content and post(s). This includes information posted by anyone that has not been recently active on the site(s). If you wish for any user to delete any information that you publicly or privately shared, you acknowledge that you must deal directly with that User. You understand and agree that FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com cannot be held liable or responsible for those third parties.
11. You agree that, to the maximum extent permitted by law, FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com will have no liability arising from any interactions you have with any users or third party organizations found on our websites.
12. You are old enough to legally hire Independent Contractors.

Independent Contractors

1. FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com are compensated by Hiring Managers and/or Companies for the posting of jobs or requests. These posts are provided by third parties over whom FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com has no control. If a post or request violates our Terms of Service, FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com will remove it as soon as possible after we are notified. We do not actively review every post or message.
2. Hiring Managers and/or Companies may make false or misleading claims or statements about their company or available position(s). You know and understand this and will not hold FilipinoContractors.com, FilipinoContractors.ph, and/or DarinPhillips.com responsible or liable for false or misleading statements made by any user(s). Nor will you hold FilipinoContractors.com, FilipinoContractors.ph, and/or DarinPhillips.com for decisions or actions you take as a result of lies told by any User.
3. The Hiring Manager and/or Company is responsible and liable for compliance with all applicable laws and regulations in their location. Independent Contractors are responsible for and liable for compliance with all applicable laws and regulations in their location. FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com are not liable for legal, regulatory, ethical, or other violations by the Hiring Manager and/or Company and the Independent Contractor.

You agree that you are personally responsible for determining which independent contractor roles to pursue and which steps you are willing to take in the selection process. You also agree that Hiring Managers and/or Companies may directly contact you based on the information that you provide on FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com. There is no guarantee that any of the opportunities are a good fit for you - or that you will be a good fit for any of the opportunities.
7. If you publish your resume or information on FilipinoContractors.com, FilipinoContractors.ph, and/or DarinPhillips.com, you understand that other users can search the site and find your post(s). All Users

You agree to abide by the following:

• Do not intentionally post false or misleading information. This includes impersonating another person or organization.
• Do not post fraudulent, unlawful, discriminatory, threatening, abusive, obscene, or biased information. Do not request or post anything that would violate local laws or regulations.
• Do not discriminate against any user for any reasons that are not directly related to the ability to perform.
• Do not solicit participation in pyramid schemes, investment opportunities, or other opportunities that are not directly related to selecting or being selected as an independent contractor.
• Do not attempt to communicate with any user that asked not to be contacted.
• All positions must exchange work for payment. No unpaid positions (e.g. internships) are permitted. No independent contractor may offer their services for free.
• Do not request or post biometric or official identification on FilipinoContractors.com, FilipinoContractors.ph, and/or DarinPhillips.com. This includes national identification numbers, photos of official documents, or other identifiers. Employment verification should only take place after a firm offer has been made - and that should be done off of our site(s) and platform(s).
• Do not require candidates to pay for any screening services. Candidates may not offer to pay for any screening services. Hiring Managers and/or Companies must pay for all steps in the sourcing, attracting, screening, and selecting processes - including any new hire training, background checks, assessments, drug tests, etc.
• Do not create a new account if you have been banned under any other alias.
• Do not post any protected information (e.g. copyrighted, trademarked, or confidential content) unless you have explicit, written permission from the content owner. You agree to defend, indemnify and hold harmless FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com and its users from any claims resulting from all posted content. You agree to pay for all legal expenses, damages, royalties, and other fees and penalties associated with any and all information and collateral you post on FilipinoContractors.com, FilipinoContractors.ph, and/or DarinPhillips.com.
• Do not copy or redistribute any content or functionality found on FilipinoContractors.com, FilipinoContractors.ph, and/or DarinPhillips.com.
• Do not sell or disclose any information found or sourced through FilipinoContractors.com, FilipinoContractors.ph, and/or DarinPhillips.com.
• Do not attempt to enter or upload malicious code or to modify FilipinoContractors.com, FilipinoContractors.ph, and/or DarinPhillips.com.
• Do not attempt to access any information or code from FilipinoContractors.com, FilipinoContractors.ph, and/or DarinPhillips.com without permission.
• Do not attempt to bypass any limitations or functionality on FilipinoContractors.com, FilipinoContractors.ph, and/or DarinPhillips.com.
• Know and abide by our Privacy Policies.

Other actions that are deemed to be detrimental to the Indepenct Contractors, Hiring Managers and/or Companies, other users, and our own company and reputation are also prohibited.

Violations will result in immediate removal and a permanent ban from FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com. Do not expect restrictions or warnings. We take the treatment of everyone we work with and for to be critical.

If you identify and share any ideas, feedback, opinions, or points of view about how the sites/platforms operate or about the information found on FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com, you agree that FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com can use that information without any additional compensation to you. You grant FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com a nonexclusive, worldwide, perpetual, irrevocable, royalty-free right and license to make, use, sell, sublicense, reproduce, distribute, perform, display, prepare derivative works from and otherwise exploit all such information for any purpose without restriction.

You agree to comply with all applicable laws and regulations, including U.S., Philippine, or other export and re-export control laws and regulations, copyright laws and other laws regarding intellectual property. You represent, warrant and covenant that you are not (a) located in, or a resident or a national of, any country subject to a U.S. or Philippine government embargo, sanctions, or other restriction, or that has been designated by the U.S. or Philippine government as a “terrorist supporting” country; (b) on any U.S. or Philippine restricted list; or (c) the subject of sanctions consistent with U.S. or Philippine law imposed by the government of the country where you are using FilipinoContractors.com, FilipinoContractors.ph, and/or DarinPhillips.com.

Disclaimer of Warranty and Limitations of Liability

You agree to not hold FilipinoContractors.com, FilipinoContractors.ph, and/or DarinPhillips.com responsible or liable for the failure of any of those vendors.

Technology is difficult to manage and there are malicious actors trying to exploit weaknesses in any code. FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com does not guarantee that the sites and platforms are error-free, secure, or safe to use.

FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com provide advice, tips, and suggestions based on research and user feedback. You understand and agree that opinions are not always correct and that research can be faulty or biased. TO THE EXTENT PERMITTED BY LAW, THE MAXIMUM AGGREGATE LIABILITY OF FILIPINOCONTRACTORS.COM, FILIPINOCONTRACTORS.PH, AND DARINPHILLIPS.COM AND THEIR AFFILIATES, AND THEIR THIRD-PARTY LICENSORS, FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, SHALL BE LIMITED TO THE AMOUNT YOU PAID FILIPINOCONTRACTORS.COM, FILIPINOCONTRACTORS.PH, AND DARINPHILLIPS.COM TO USE THE SITES.

Governing Laws and Indemnification

Any disputes arising out of or in connection with these Terms of Service are governed by the state of Florida and any actions must be filed only in courts in Orange County, Florida. All users of FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com from outside of the United States may enjoy the protections provided by laws in the country in which they have a habitual residence.

You shall indemnify, defend and hold harmless FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com, its agents, affiliates, and licensors from any claim or liability (including without limitation reasonable legal fees) arising out of or related to: (a) your violation of any term of this Terms of Service; (b) your use of, and access to FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com; (c) your loss of, or disclosure of, information gained from using FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com; (d) your violation of any applicable laws or regulations, including but not limited to the Fair Credit Reporting Act, any applicable employment, equality, or discrimination laws, and any applicable data protection or privacy laws (this includes any claims that Indeed as your agent violated any such laws); (e) your violation of any third party right, including without limitation any copyright, property, or privacy right; (f) any claim that your content caused damage to a third party; (g) your actions as a Hiring Manager and Company or Independent Contractor, including without limitation doing or not doing or participating in the following: sourcing, attracting, screening, or selecting user(s); or (h) the activities of any third-party service providers you engage to assist you with activities related to your use of FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com. This defense and indemnification obligation will survive this Terms of Service and your use of FilipinoContractors.com, FilipinoContractors.ph, and DarinPhillips.com.
